Two Illinois residents Steven Vance and Tim Janecyk have sued Amazon, Alphabet (Google’s parent company) and Microsoft for using people photos to train their face recognition technologies without permission and for violating biometric laws Illinois Privacy Policy.

According to Bloomberg, the photographs used were part of the IBM Diversity in Faces database, designed to further examine the objectivity and accuracy of face recognition. The database contains 1 million images of human faces, marked with special marks, such as face symmetry, nose length and forehead height.

According to Vance and Janechik, their images were included in this database without their permission. The collection, storage and use of biometric information is unlawful without written consent in accordance with the Illinois State Legislature Confidentiality Act of 2008.

“The defendants used biometric identifiers and information scanned from photographs that were downloaded from Illinois and managed them through user accounts, computers, and mobile devices in Illinois,” the prosecution said.
